Terms and conditions
1 Scope of Application
1.1 These General Terms and Conditions (GTC) apply to all contracts concluded between EcoTECH Efficiency Fetoshi GmbH, Ulmer Str. 37, 73728 Esslingen am Neckar, Germany (hereinafter “Seller”) and the customer (hereinafter “Buyer”) regarding the sale and delivery of products offered on this website.
1.2 Deviating terms of the Buyer shall not be recognized unless expressly agreed to in writing by the Seller.
2 Ordering Process and Conclusion of Contract
2.1 The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order. Errors excepted.
2.2 The Buyer may select products and place them in the shopping cart. By clicking “Order”, the Buyer submits a binding offer to purchase the goods in the cart.
2.3 Before submitting the order, the Buyer may review and modify the data at any time.
2.4 The Seller sends an automatic order confirmation by email. This does not constitute acceptance. The contract is concluded only upon separate order confirmation by the Seller.
3 Prices and Payment Conditions
3.1 All prices include statutory VAT plus shipping costs.
3.2 Payment may be made by advance payment, credit card, or PayPal. The Seller reserves the right to exclude certain payment methods.
3.3 The purchase price is due immediately upon conclusion of the contract unless otherwise agreed.
4 Delivery and Product Availability
4.1 Delivery is made to the address specified by the Buyer.
4.2 Delivery times are non-binding unless expressly agreed otherwise.
4.3 If delivery fails after three attempts due to Buyer’s fault, the Seller may withdraw from the contract and refund payments.
4.4 If the product is unavailable without fault of the Seller, the Seller may withdraw and refund any payments made.
5 Delivery and Shipping

6 Retention of Title
The goods remain the property of the Seller until full payment has been made. For business customers, extended retention of title and special provisions apply.
7 Right of Withdrawal
7.1 Consumers have a statutory right of withdrawal.
7.2 No right of withdrawal exists for sealed goods that are unsuitable for return for hygiene reasons once unsealed.
8 Warranty and Liability
8.1 Statutory warranty rights apply.
8.2 The Seller is liable only for intent or gross negligence.
8.3 A warranty exists only if expressly granted.
8.4 – 8.7 Special rules apply for business customers regarding inspection, notification of defects, limitation periods, and installation costs.
9 Data Protection
9.1 Personal data is processed in accordance with statutory regulations.
9.2 Data will not be disclosed to third parties without consent unless required for contract performance.
10 Final Provisions
10.1 German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.
10.2 Place of jurisdiction is the Seller’s registered office.
10.3 If any provision is invalid, the remaining provisions remain effective.
